This Privacy Policy describes the collection, use and disclosure of information on this website, including on mobile devices and tablets on which you are viewing this website, as well as any mobile sites or applications we offer (together, this “Website”), and in connection with email messages we may send to you. Except as described below, this Privacy Policy does not govern our offline privacy practices.  This Website is owned and operated by title companies operating as DHI Title (hereinafter “DHI Title,” “we” or “us”).

Where applicable, you consent to the use of your information as described in this Privacy Policy each time you access or use our Website, so we urge you to read this document in full, and Contact Us if you have any questions.  Capitalized terms in this Privacy Policy are defined in the Definitions section of this Privacy Policy.  Throughout this Privacy Policy, where we refer to residents of a particular location, we mean individuals who are currently resident in that location as indicated by information about their place of residence they have provided to us (such as through submission of an online form), where reasonably available, or otherwise by their IP address.

Categories of Information We Collect Online and Offline

When you interact with DHI Title, we collect information from that interaction, for example, from your visits to, and use of, our Website, from your email correspondence to us, from your submittal of an online employment application, from your online responses to us and from other things that you post online, for example, on social media public pages and profiles on Facebook, Twitter and Instagram.  When this information is reasonably capable of being associated with you, we refer to this information as Personal Information.
 
Certain Personal Information that we collect is Non-Public Personal Information or NPPI.  NPPI generally includes non-public personally identifiable financial information that we have collected from or about you, or that has resulted from a transaction for you in our delivery of financial products and services to you.  NPPI also includes any list, description, or other grouping of consumers and their publicly available information that is derived using any personally identifiable financial information that is not publicly available. We use, share and protect NPPI in accordance with the DHI Title U.S. Consumer Privacy Notice, your privacy choices and applicable law.
 
At DHI Title, we may collect and share the following categories of Personal Information, and have collected and shared such categories of Personal Information, in the preceding twelve (12) months:
 

Identifiers.

Identifiers are information directly linked to a particular individual.  For example, depending on the circumstance, DHI Title may collect your name, address, email address, or phone number as part of the delivery of settlement services, acting as a title insurance agent or other interaction.  Identifiers also include more sensitive information that may be gathered from you, including your social security number or driver’s license number, where that information is necessary in order to complete a transaction.  If you request us to provide settlement services, assist with obtaining title insurance for you, or otherwise engage in a commercial transaction with us, we also may also collect financial information and other information necessary to complete your transaction.
  
We collect this information from you, from publicly available sources, and from our Third-Party Service Providers and other third parties, and do so for the purpose of completing transactions into which you have entered, or to provide you with information about our products and services.  Depending on the nature of your interaction with DHI Title, we may be required by law to collect this information.
 
At times, we may share Identifiers with our Third-Party Service Providers, our Affiliates, or other third parties to complete the transactions into which you have entered.  In addition, we may share Identifiers with our Third-Party Service Providers, our Affiliates or other third parties in order to showcase our products and services or the products of our Affiliates that may be of interest to you.  In all cases, however, where we have collected NPPI, our use,  sharing and protection of such NPPI is in accordance with our U.S. Consumer Privacy Notice and your privacy choices as well as applicable law.
  

Customer Records.

Certain Identifiers may also be included in our customer records.  These are records of our business transactions and interactions with you, and often include your name, address, or other information collected during, and for the purpose of effectuating, those business transactions.  We collect this information from you, or from our Third-Party Service Providers acting on our behalf.  Our use of this information, and use by our Third-Party Service Providers with which it is shared, are identical to the way we handle “Identifiers,” as described above. 
 

Legally Protected Characteristics.

Depending on the nature of our interaction with you, we may be required under state or federal law to collect certain information related to legally protected characteristics.  This may include your age, sex, gender, sexual orientation, race, or ethnicity.  We collect this information from you, and maintain this information in order to confirm compliance with certain legal obligations, or otherwise provide you with information about our products and services. 
 

Commercial Information.

Depending on the nature of our interaction with you, we may collect certain commercial information related to you, including property records or records of past purchases involving DHI Title, its Affiliates, or our Third-Party Service Providers.  We collect this information as a result of our transactions with you, either from you directly or from our Third-Party Service Providers acting on our behalf.  We may also collect certain commercial information from publicly available sources in order to facilitate our transactions with you.
 
We use this information to complete our transactions with you and to maintain a record of those transactions as is often required by applicable laws and regulations.  We also use this information to provide you with information related to our products and services that may be of interest to you.  While we do not often share this information with third parties, at times we share this information with our Third-Party Service Providers, including our financial processing service providers and other entities that assist us in facilitating our transactions with you, for these purposes.  We may also share this information with DHI Title Affiliates, our analytics providers, and our interest-based advertising providers for these purposes. In all cases, however, where we have collected NPPI, our use, sharing and protection of such NPPI is in accordance with our U.S. Consumer Privacy Notice and your privacy choices as well as applicable law.
 

Internet Activity and Identifiers.

When you interact with DHI Title online we may collect certain information about you, including your browsing history, your interactions with our various Websites, pages, or advertisements, your IP Address, and other unique online identifiers that may be associated with you or your device.  We obtain this information primarily from the use of Cookies and similar technologies, and we describe our use of Cookies in more detail elsewhere in this Privacy Policy. 
 
We collect this information in order to enhance your experience on our Websites, and to ensure the information we provide to you is relevant to your interests.  We share this information with DHI Title Affiliates and certain of our Third-Party Service Providers, such as our analytics providers and our interest-based advertising providers. In all cases, however, where we have collected NPPI, our use, sharing and protection of such NPPI is in accordance with our U.S. Consumer Privacy Notice and your privacy choices as well as applicable law.
 

Geolocation Data.   

You may provide certain location information to us as part of your inquiry into our products and services, or as part of the mortgage application process.  In addition, if you interact with DHI Title, through the use of your mobile device, we may obtain certain geolocation data from that interaction.  We obtain this information through your mobile device’s interactions with our mobile sites and applications.
 
We obtain this information in order to more accurately provide you with information.  We share this information with DHI Title Affiliates and certain of our Third-Party Service Providers, such as our analytics providers and our interest-based advertising providers. In all cases, however, where we have collected NPPI, our use, sharing and protection of such NPPI is in accordance with our U.S. Consumer Privacy Notice and your privacy choices as well as applicable law.
 

Video or Audio Recordings.

Depending on the nature of your interaction with us, you may have provided us with video or audio recordings.  These may be recordings of your interactions with our customer representatives or voicemails you may leave us. We do not collect video or audio recordings without your consent, and use those recordings only for training purposes or to respond to your request.  We may also use testimonial recordings for marketing purposes but will only do so with your consent.
 

Professional or Employment-Related Information.

DHI Title may collect certain professional or employment-related information about you, either as part of our business transactions with you, or in connection with your employment—or application for employment—with DHI Title or one of our Affiliates.  In this way, we collect professional information from you directly, and for the specific purposes outlined during the collection.   
 
While we may share your professional or employment-related information with third parties as required by law or to facilitate our transactions with you, we do not share your professional information with third parties for other purposes.  We may share this information with our Third-Party Service Providers or Affiliates, but otherwise do not share this information with other third parties.
 

Educational Information.

DHI Title may collect certain educational information about you either as part of our business transactions with you, or in connection with your employment—or application for employment—with DHI Title or one of our Affiliates.  In this way, we collect educational information from you directly, and for the specific purposes outlined during the collection.   
 
While we may share your educational information with our Affiliates and third parties, such as our Third-Party Service Providers, to facilitate our transactions with you, we do not share your educational information with third parties for other purposes.
 

Other Information We Collect:

Anonymous Information: Other information that we collect is Anonymous Information – that is, information that does not include Personal Information, or from which Personal Information has been deleted. Anonymous Information does not identify, and cannot be used to reasonably determine, the identity of an individual customer. Anonymous Information may include demographic and other general information that you may provide to us; it may include some, but not all, Automated Information collected through Cookies, including pixels and other technologies such as browser and other device information; and it may include high-level, non-specific location information and other information collected from your mobile devices.
 
Aggregate Information: We may also gather Anonymous Information of many individuals and combine that information. Aggregate Information does not identify, and cannot be used to reasonably determine the identity of, an individual customer. Aggregate Information is about groups or categories of customers rather than individual visitors.

If you end your relationship with us, we will continue to safeguard your Personal Information in accordance with this Privacy Policy and our U.S. Consumer Privacy Notice, as well as the other privacy notices linked to this Privacy Policy.

We collect Personal Information, including NPPI, about you from the following sources:

Information we receive from you - You may provide information to us online or otherwise, or in discussions with us via the Internet including Live Chat, by telephone or otherwise, such as your income, assets, liabilities, social security number, and other financial and credit information.  Unless prohibited by applicable law, we may combine information that you provide to us online with information that you provide to us off-line, with publicly available information or with information provided to us by third parties such as social media platforms and data aggregators.

Information about your transactions with us or others - We may obtain information regarding your transactions and experiences with us or others, such as your payment histories, account balances, and other transaction records. 

Information we receive from outside sources - We receive information from third parties such as your employment history, property insurance coverage, and banking relationships.

Information we receive from consumer reporting agencies -  We receive information from consumer reporting agencies such as your credit history, credit usage, and credit score. 

Email -  If you provide your email address to us and do not opt out from receiving commercial emails from us, you may receive emails from us regarding DHI Title products and services, and we will collect your email address and other information that you provide as well as Automated Information that we collect. You may Opt-Out of the receipt of email communications from DHI Title by clicking an “unsubscribe” button in email communications from DHI Title.

Social Media - DHI Title and its Affiliates may maintain profiles and pages on social media platforms including, but not limited to, Facebook, Twitter and Instagram. DHI Title may collect the information that you post on social media platforms including Personal Information, pictures or other information. Information posted on such pages is also subject to the privacy policies and terms of use of the respective social media platforms.
 
Collection of Automated Information - We and our Third Party Service Providers have automated means of collecting information from you when you visit our Website or otherwise interact with us online. We use the information collected for many purposes - to allow user-friendly visits to our Website by, for example, improving your ability to navigate our Website, to personalize your interaction with us and to allow our servers to recognize your browser the next time you visit our Website; to improve security on our Website; and to inform us of activity concerning our Website. We also collect and develop statistical, Aggregate Information to continually improve the functionality of our Website and support our marketing efforts.

Your Settings – Some of the Automated Information that would otherwise be collected by us and our Third Party Service Providers or other third parties may be limited by your computer, mobile device or tablet settings; however, changing your settings does not guarantee that your information will not be collected or that you will not be tracked on the Internet. Settings that do not allow certain technologies may interfere with your use of our Website. For example, if you do not allow the use of Cookies, our servers will not be able to recognize your browser. Through Your Use of Your Mobile Device -  If you are using a mobile device to interact with our Mobile Applications, we may collect information about your online behavior utilizing your device's Mobile Advertising Identifier or other temporary numeric identifier. This allows us to follow your online behavior without accessing your mobile device's permanent identifier. As part of the collection of Automated Information from your mobile device, we may collect information about your physical location. We use this information to provide you with geographically based material. We may share your physical location with our Third-Party Service Providers so that they may combine this information with other information about your browsing behavior such as the advertisements that you viewed. This allows us and our Third-Party Service Providers to share with you information that is of interest to you. This information may also be used by Third-Party Service Providers to track you across the devices that you use. Most mobile devices contain built in privacy controls that will allow you to opt-out of interest based advertising or cross application advertising. Most also have functionality that will allow you to change your Mobile Advertising Identifier. In all cases where we have collected NPPI, our use. sharing and protection of such NPPI is in accordance with our U.S. Consumer Privacy Notice and your privacy choices as well as applicable law.
 
If you are a resident of the European Economic Area, without your consent we will not collect location information from your device, use that information to provide you with geographically based material, or share your physical location with our Third-Party Service Providers so that they may combine that location with other information about your browsing behavior to share information of interest with you, or track you across different devices.

Our Use of Your Information and the Categories of Third Parties with Whom We Share Your Information

We also may share your Personal Information including NPPI, as permitted by law, for such limited purposes as protecting the confidentiality or security of records in connection with your loan or other financial product or service, protecting against or preventing fraud or unauthorized transactions, resolving consumer disputes or inquiries, reporting to consumer reporting agencies about your transactions with us, responding to judicial process or otherwise complying with properly authorized investigations, subpoenas, or summons by federal, state, or local authorities, and complying with other applicable legal requirements.
 
And, if you submit an application for employment with us, we may disclose or provide access to the Personal Information that you provide to employees, our Affiliates or Third Party Service Providers involved in the recruiting, hiring and on-boarding of our applicants.

Sharing of Your Credit Information with Our Affiliates

All of the information we collect about you may be shared with our Affiliates, as permitted by law, subject to your legal right to prevent such sharing in cases of certain types of information. Under the federal Fair Credit Reporting Act (“FCRA”), you may direct us not to share “personal credit information.” Personal credit information is information that bears on your creditworthiness, personal characteristics and mode of living and is not information about our own transactions and experiences with you (such as your account balances and payment history with us). Personal credit information may include information provided by you on your loan application concerning your accounts with others and information contained in your consumer credit report such as your credit score. Under FCRA, you may also direct us not to allow our Affiliates, with which you do not have a pre-existing business relationship, to use “eligibility information” to make marketing solicitations to you. Eligibility information is information used by us to determine your eligibility for a loan including, but not limited to, information about your transactions and experiences with other parties and information contained in a consumer credit report or obtained from you or other third parties. Despite your direction to us not to share personal credit information with our Affiliates or your direction to us not to allow our Affiliates with which you do not have a prior business relationship to use your eligibility information to make marketing solicitations to you, we may continue to share, with our Affiliates, transactional and experience information about our own transactions and experiences with you including, but not limited to, your account balances and loan repayment history with us and your identification information such as your name and address. However, if you have opted out from Affiliate marketing, our Affiliates may not use such information to market to you. If our Affiliates service your loan or process your accounts, we can share additional information with these Affiliates, including personal credit information and eligibility information but only for those limited purposes.

Our Confidentiality Practices

We protect all of your Personal Information including your NPPI in accordance with applicable law. We restrict access to all Personal Information about you to our employees or Third Party Service Providers who need to know that information to provide products or services to you, process and service your account, or administer and market our business. We require our employees to treat the NPPI of our customers and former customers as strictly confidential.

Our U.S. Consumer Privacy Notice

Our U.S. Consumer Privacy Notice has been posted on this Website, and the ability to make privacy choices online has been made available, for the convenience of those doing business with us. We will provide a copy of our current U.S. Consumer Privacy Notice electronically, if you have agreed to do business electronically, or by mail or in person in accordance with the requirements of Title V of the Gramm-Leach-Bliley Act, Pub. Third Party Collection of Personal Information about Your Online Activities Over Time and Across Different Websites

We do not engage service providers to collect Personal Information about your online activities over time and across different websites. However, other websites that you may have visited before visiting our Website may have permitted their service providers to embed automated technologies such as third party Cookies to track your activities on our Website and other websites that you may visit after leaving our Website. You should always review the privacy policies of the websites you visit to understand how Personal Information about your online activities over time and across different websites is being collected.

Do Not Track Signals

Some web browsers may give you the ability to enable "Do Not Track” functionality. "Do Not Track” is a browser setting that requests that web applications eliminate their tracking of you. When you choose to turn on your "Do Not Track” setting, your browser sends a signal to third-party ad servers, digital advertising networks, digital advertising networks, data aggregators and others to stop tracking you. This is different than disabling Cookies on your browser. Browsers with the "Do Not Track” functionality enabled continue to have the capability to accept Cookies.
